Terms of Service

Fable & Kin is not yet a registered legal entity — until it is, this Service is operated by the individual running Fable & Kin, trading as “Fable & Kin”, New Zealand. A registered entity name and address will be added here before a general public launch.

These Terms of Service (“Terms”) govern your use of the Fable & Kin website at fableandkin.org and the personalised children’s book service (the “Service”), operated by Fable & Kin, New Zealand (“Fable & Kin”, “we”, “us”). By using the Service or placing an order, you agree to these Terms.

1. Who may use the Service

You must be at least 18 years old and able to enter a binding contract.

The Service lets you create personalised books that may feature a child. You confirm that you are the parent or legal guardian of any child whose name, photograph, likeness, or details you provide, orthat you have the express permission of that child’s parent or legal guardian to use them for this purpose.

You are responsible for all activity under your account or guest session.

2. How the Service works

You provide inputs — a story idea or your own text, character names and descriptions, optional photographs, an occasion, a dedication, and style choices.

We use these inputs, together with third-party artificial-intelligence models, to generate a draft story and illustrations (the “Generated Content”). You can edit the text before purchase.

After payment, we generate the complete book, you review and approve it, and we produce a digital edition and/or a printed book through our print partner.

3. Artificial intelligence — important disclosures

The story text and illustrations are created by automated AI systems based on your inputs. They are not drawn or written by a human artist or author on a per-book basis.

Illustrations that draw on a photograph are a stylised artistic interpretation, not a photographic likeness. The Service does not promise that any character will look exactly like a real person.

Generated Content may contain inaccuracies, unexpected elements, or imperfections. The review-and-approve step exists so you can check the book before it is printed. Once you approve a book for print, it is produced as approved.

To generate your book, your inputs (including photographs and text) are transmitted to and processed by our AI sub-processors — see our Privacy Policy. Do not submit inputs you are not permitted to share.

4. Acceptable use

You agree not to upload, submit, or request, and not to use the Service to create:

We may refuse, suspend, cancel, or remove any order or content that we reasonably believe breaches this section, and may report unlawful material to the authorities.

5. Intellectual property

Your inputs. You retain ownership of the text, descriptions, and photographs you provide. You grant us a limited, worldwide licence to use them solely to operate the Service and create, produce, and deliver your book.

Your finished book. On full payment, we grant you a personal, non-exclusive licence to use, print for personal use, and share your finished book for personal, non-commercial purposes.

Our platform.The Fable & Kin name, logo, website, writing and illustration systems, prompts, templates, and underlying technology remain our property. Nothing in these Terms transfers them to you.

6. Orders, pricing, and payment

Prices for digital and printed editions are shown on the pricing section of fableandkin.org and at checkout, and may change, but the price you are charged is the price shown when you order.

Payment is processed by Stripe. We do not store your full card details.

Printed books are made to order and personalised specifically for you.

7. Production, delivery, and shipping

Printed books are produced and shipped by our print-on-demand partner, Gelato. Production and delivery times are estimates, not guarantees.

Risk and title in a printed book pass to you on delivery. You are responsible for providing a correct shipping address; we are not liable for non-delivery caused by an incorrect address.

Digital editions are delivered electronically once your book is approved and produced.

8. Cancellations, refunds, and defects

Because printed books are personalised and made to order, you do not have a general right to cancel or return for change of mind once production has begun, except where required by applicable consumer law (in New Zealand, the Consumer Guarantees Act 1993).

You can edit and must approve your book before production. Please review carefully — we are not responsible for spelling, names, or content you approved.

If your printed book arrives damaged, defective, or materially different from the version you approved, contact us at hello@fableandkin.org within 14 days with photos and we will reprint or refund it at our discretion.

Nothing in these Terms excludes rights you have under non-excludable consumer law.

9. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all implied warranties.

We do not warrant that Generated Content will be error-free, that any likeness will be accurate, or that the Service will be uninterrupted.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service or any order is limited to the amount you paid for the order giving rise to the claim.

We are not liable for indirect, incidental, special, or consequential losses.

These limits do not apply to liability that cannot be limited by law (e.g. for death or personal injury caused by negligence, fraud, or non-excludable consumer guarantees).

11. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms, including any claim that your inputs infringed someone’s rights or that you lacked authority to use a child’s name, likeness, or photograph.

12. Suspension and termination

We may suspend or terminate your access if you breach these Terms or to comply with law. You may stop using the Service at any time.

13. Changes to these Terms

We may update these Terms. Material changes will be posted on this page with a new “Last updated” date; continued use after changes means you accept them.

14. Governing law and disputes

These Terms are governed by the laws of New Zealand, and disputes are subject to the non-exclusive jurisdiction of the courts of New Zealand.
